Terms of Use
In these Terms of Use, "application" means the POAL Carbon
Calculator web based application owned by Port of Auckland
and developed by Abley Limited. Your access to and use of
this application is governed by these terms of use. You
agree to be bound by and comply with these terms of use. If
you do not agree to these Terms of Use you are not
authorised to access and use the application, and you must
immediately stop doing so.
POAL reserves the right to update and/or amend these terms
from time to time and without notice. By continuing to use
the application you agree to these amended terms.
POAL may change, suspend, discontinue, or restrict access
to, the application without notice or liability.
These Terms of Use were last updated February 2022.
Information and professional advice
The content and outputs are provided for information
purposes only. The application uses independently verified
emissions factors and methodology. Whilst every effort has
been made to supply accurate results, errors and omissions
may occur and POAL do not guarantee any such content or
outputs will be current, accurate or complete. If you choose
to use the content and outputs generated then you assume all
risks associated with its use.

To the fullest extent permitted by law neither POAL nor
any person or entity involved in creating, producing or
distributing the application or its contents or any
outputs will be held liable for any loss, damage or injury
of any kind rising out of access to or the use of this
application or your reliance upon content or outputs
accessed through it;

All warranties, representations and guarantees (whether
express, implied or statutory) are excluded, including
without limitation, suitability, fitness for purpose,
accuracy, availability or completeness of this application
or the content or outputs accessed through it;

POAL will not be liable for any computer or software
viruses or other forms of interference which may damage
your computer system or expose you to fraud when you
access or use the application. To avoid doubt, you are
responsible for ensuring the process by which you access
and use the application protects you from this;

not imply any endorsement, approval or recommendation of,
or responsibility for, those sites or their contents,
operations, products or operators.
Ownership and use of content
The application is protected by copyright, trademarks and
other intellectual property laws. All rights, title and
interest in the application and content (including all
information, data, text, graphics, artwork, photographs,
logos, icons, and look and feel), and the underlying systems
are owned, licensed or controlled by Port of Auckland
Limited or the party credited with the content. You must not
copy, alter, modify, reproduce, reverse assemble or reverse
compile or permit any other person do the same in respect of
the application.
You may not use the application for any other purpose or in
any other way without the express written consent of POAL.
In particular you must not:

scrape, hack, reverse engineer, compromise or impair the
application or contents;

use bots, crawlers, scrapers, or other automated means to
access or collect data or other content from or otherwise
interact with the application;

hack, avoid, remove, impair, or otherwise attempt to
circumvent any security or technological measure used to
protect the application or content;

take any action that could damage or adversely affect the
performance or proper functioning of the application;

must obtain our written permission to establish a link to

Jurisdiction
When using the application you are solely responsible for
compliance with local laws. This site is governed by and is
to be interpreted in accordance with the laws of New Zealand
and will be dealt with by New Zealand courts.
If any part or provision of these Terms of Use is or becomes
illegal, unenforceable, or invalid, that part or provision
is deemed to be modified to the extent required to remedy
the illegality, unenforceability or invalidity. If a
modification is not possible, the part or provision must be
treated for all purposes as severed from these Terms of Use.
The remainder of these Terms of Use will be binding on you.
